I write to address some of the inaccuracies in your article "RSLs cannot inherit possession cases, court says" (11 April, page 8).

The case to which you referred actually confirmed that registered social landlords can inherit a council's possession cases after a stock transfer and pursue tenants for rent arrears and previous antisocial behaviour.

There is no opportunity for tenants facing a proposed stock transfer to stop paying their rent in the belief that the receiving RSL will not be able to do anything about it.

This is precisely why we took on the case and we have been successful in obtaining a sensible judgment.

The case is also important because it outlines a speedy and cost-effective procedure allowing RSLs to inherit proceedings that should not involve additional court hearings.

The result is that, after transfer, RSLs can examine the cases they have inherited and proceed on those cases where rent arrears or nuisance justify continued action.
