Conservative MP andrew turner is to meet housing minister Lord Rooker to discuss a legal precedent that is delaying the eviction of antisocial tenants with mental health problems.
North Devon Homes v Brazier, decided in April (HT 11 April, page 10), ruled that a mentally impaired tenant could not be evicted unless it could be shown that they posed a danger to their neighbours.

Turner, MP for the Isle of Wight, is due to raise the matter with Lord Rooker at a meeting scheduled for next month.

He said a man with mental difficulties in his constituency was allowed to return to his home despite having twice set fire to the property.

Medina Housing Association, the man鈥檚 landlord, has since moved two neighbours into alternative accommodation for their own safety. Action to evict the man cannot continue until he is given a full mental health assessment, which could take several months.

Turner said: 鈥淭enants鈥 lives are being made a misery by the inability of a landlord to evict.鈥
